1. Introduction

Welcome to EnviroGas. Gas On Tap is our revolutionary cylinder service exchange service. As soon as your gas runs out - we deliver a fresh cylinder. These Terms and Conditions govern your use of our Gas On Tap cylinder swap service, including all related services, products, and client portal access. By registering for an account or using our services, you agree to be bound by these terms.

2. Account Registration and KYC Requirements

2.1 Eligibility: You must be at least 18 years of age to register for an EnviroGas account. Corporate clients must be duly registered business entities.

2.2 KYC Documentation: All clients must complete Know Your Customer (KYC) verification by submitting:

  • For Individual Clients: National ID or Passport, and Proof of Address
  • For Corporate Clients: Business Registration Certificate and Proof of Address

2.3 Account Approval: Your account will be activated upon successful KYC verification by our compliance team. We reserve the right to reject any application without providing reasons.

2.4 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3. Deposit System

3.1 Deposit Requirement: A refundable deposit of $100 USD per gas cylinder is required before you can place orders.

3.2 Purpose: The deposit secures your access to our cylinder swap service and covers the cost of the gas cylinder container (not the gas itself).

3.3 Additional Deposits: You may purchase additional deposits at any time to increase the number of cylinders you can have in your possession.

3.4 Deposit Refund: Deposits are fully refundable when you return all cylinders in good condition and close your account. Refunds will be processed within 14 business days of cylinder return and account closure request.

3.5 Damaged Cylinders: If a cylinder is returned damaged beyond normal wear and tear, the deposit for that cylinder may be forfeited to cover replacement costs.

4. Gas Cylinder Swap Service

4.1 Service Description: Our Gas On Tap service allows you to swap empty gas cylinders for full ones on a scheduled basis.

4.2 Ordering: Orders can be placed through the client portal. You can only order up to the number of cylinders for which you have paid deposits.

4.3 Delivery: We will deliver full cylinders and collect empty ones during the scheduled delivery window. Delivery times are estimates and may vary due to operational factors.

4.4 Gas Pricing: You pay only for the gas content, not the cylinder. Current gas prices will be displayed when placing orders and are subject to change based on market conditions.

4.5 Cylinder Ownership: All gas cylinders remain the property of EnviroGas at all times. Clients are granted possession for use only.

5. Payment Terms

5.1 Payment Methods: We accept Bank Transfer, EcoCash, OneMoney, InnBucks, and Cash payments at our office.

5.2 Invoicing: Invoices will be generated for each deposit payment and gas refill order. All invoices are sent via email to your registered email address.

6. Safety and Responsibilities

6.1 Safe Usage: Clients must use gas cylinders in accordance with manufacturer instructions and all applicable safety regulations.

6.2 Storage: Cylinders must be stored in well-ventilated areas away from heat sources, open flames, and direct sunlight.

6.3 Inspection: Clients should inspect cylinders upon delivery and report any visible damage immediately.

6.4 Liability: EnviroGas is not liable for injuries or damages resulting from improper use, storage, or handling of gas cylinders.

6.5 Prohibited Actions: Clients may not tamper with, modify, refill, or attempt to repair cylinders. Cylinders are strictly prohibited from being used for gas retailing purposes. Such actions will result in immediate account termination and forfeiture of deposits.

7. Service Suspension and Termination

7.1 Suspension: We reserve the right to suspend service for non-payment, violation of terms, or safety concerns.

7.2 Client Termination: You may terminate your account at any time by returning all cylinders and requesting account closure through the client portal or customer service.

7.3 EnviroGas Termination: We may terminate accounts for repeated violations, fraudulent activity, or at our discretion with 30 days notice.

8. Data Protection and Privacy

8.1 Data Collection: We collect personal information necessary for account creation, KYC compliance, and service delivery.

8.2 Data Usage: Your information is used solely for service provision, compliance, and communication purposes.

8.3 Data Security: We implement industry-standard security measures to protect your personal and financial information.

8.4 Data Sharing: We do not sell or share your personal information with third parties except as required by law or for service delivery (e.g., delivery partners).

8.5 Data Retention: We retain your information for as long as your account is active and as required by applicable regulations.

9. Limitation of Liability

9.1 Service Availability: While we strive for continuous service, we do not guarantee uninterrupted availability and are not liable for service disruptions.

9.2 Force Majeure: We are not liable for delays or failures in service due to circumstances beyond our control, including natural disasters, strikes, or government actions.

9.3 Maximum Liability: Our total liability to you for any claims arising from our services shall not exceed the total amount of deposits and payments you have made to EnviroGas in the 12 months preceding the claim.

10. Intellectual Property

All content, trademarks, logos, and intellectual property on the platform and client portal are owned by Southern Plan Energy. You may not use, reproduce, or distribute any of our intellectual property without prior written consent.

11. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be communicated via email and posted on the client portal. Continued use of our services after changes constitutes acceptance of the modified terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law: These Terms are governed by the laws of Zimbabwe.

12.2 Dispute Resolution: Any disputes shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be submitted to arbitration in accordance with Zimbabwe arbitration laws.

12.3 Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of Zimbabwe for any legal proceedings.
